An 11-1 split ended Lindsay Clancy's murder trial after Judge William Sullivan declared a mistrial when jurors could not reach a unanimous verdict.
Nick Dargie, a juror, told ABC News the lone holdout used an exercise band and water bottle to mimic how Clancy's three children were strangled during deliberations.
Dargie said the holdout could not cite evidence or witness testimony supporting his position, echoing a foreperson's note that one juror was refusing to follow instructions on reasonable doubt.
Kevin Reddington, Clancy's lawyer, said he plans to seek dismissal on double-jeopardy grounds if needed, while a status hearing is set for Sept. 29.
Clancy, 36, has pleaded not guilty to three first-degree murder counts in the January 2023 deaths of Cora, Dawson and Callan, all under age 6.
