Kroy Biermann Jr. Faces 7 Felony Sex Charges as Court Unseals 2023 Battery Case

Several of the counts in KJ Biermann’s indictment — including aggravated sodomy, aggravated child molestation and aggravated sexual battery — fall into that category. That is why prosecutors were able to pursue the case in adult court even though he was 14 at the time of the alleged incident. But that is not the final word. His attorney, Jason Sheffield, filed a motion on Sept. 8 asking the judge to transfer the case to juvenile court, arguing that Biermann was 14 at the time and should be handled in the juvenile system. That request is still pending. So the immediate answer is that he may be tried as an adult, but it has not been decided yet. The next key step will be the court’s ruling on the transfer request. If the judge denies it, the case remains in adult court. If the judge grants it, the case would move to juvenile court, where proceedings are generally confidential and focused more on rehabilitation than adult criminal punishment.
