Judge Orders Abbott to Answer Minnesota Extradition Suit by Aug. 24 for ICE Agent

Q: Can a governor effectively block interstate extradition simply by refusing to make a final decision before the detention clock expires?

Not lawfully, but practically yes for a time. Interstate extradition is generally mandatory under the Constitution’s Extradition Clause and the federal extradition statute, and the Supreme Court has said governors have very little discretion when a valid request is made. That is why Minnesota argues Texas must return Christian Castro. The problem is timing. Texas law limits how long a person can be held awaiting extradition to about 90 days. In Castro’s case, Judge Fernando Rodriguez Jr. said he could not force Gov. Greg Abbott to sign the papers because Abbott had not made a final decision yet, so the dispute was not ripe. The judge also said he could not extend Castro’s detention past the state-law limit. Castro was then released when that detention cap expired. So a governor likely cannot legally defeat extradition on the merits simply by stalling. A court could still later order compliance if the governor formally refuses or unlawfully withholds action. But if no court intervenes before the detention period runs out, delay can work in practice by allowing the detainee to be released. Release does not erase the extradition request or the underlying charges. Texas argued it could still issue a rendition warrant later and rearrest Castro if the legal requirements are met. The real risk for the demanding state is that once the person is free, especially if considered a flight risk, bringing them back becomes much harder.

U.S. District Judge Fernando Rodriguez ordered Greg Abbott to respond by Aug. 24 to Minnesota’s request for a restraining order blocking the release of 52-year-old ICE agent Christian Castro from Texas custody.
An Aug. 25 hearing is set, and Minnesota warned Castro could be freed on Aug. 26 if the court does not intervene before Texas’s 90-day extradition holding window expires.
