Minnesota Seeks Extradition of ICE Agent on 5 Charges in Minneapolis Shooting

No. Gov. Greg Abbott’s signature would not itself send ICE officer Christian Castro to prison. It would mainly clear the last step for his extradition from Texas to Minnesota so he can face state charges in court. Castro is accused of firing through a Minneapolis home’s front door during a January immigration operation, wounding Julio Cesar Sosa-Celis and endangering others inside, including children. Minnesota has charged him with four counts of second-degree assault and one count of falsely reporting a crime. Prosecutors say video, witness accounts and physical evidence undercut his claim that he fired after being attacked. If Abbott signs the paperwork under the Uniform Criminal Extradition Act, Texas would be able to transfer Castro to Minnesota. That would force him to answer the charges there unless a court blocks or alters the process. It does not determine guilt, and it does not guarantee any sentence. The “more than 28 years” figure is the maximum possible exposure if Castro were convicted on all major counts and sentenced consecutively. In practice, any actual sentence would be decided later by a judge under Minnesota law and sentencing rules, and could be lower. There is also a jurisdictional wrinkle. Minnesota officials have said the case could be removed to federal court, but they maintain it would still be prosecuted under Minnesota law. The county attorney has also argued that any conviction in such a case would not be eligible for a presidential pardon.

Hennepin County Attorney Mary Moriarty asked Texas Gov. Greg Abbott to approve the transfer of ICE agent Christian Castro to Minnesota, calling his sign-off the final step before Castro can face state charges.
Castro, 52, is charged with four counts of second-degree assault and one count of falsely reporting a crime after prosecutors said he fired into a Minneapolis residence in January and wounded Julio Cesar Sosa-Celis in the leg.
Texas authorities arrested Castro on May 29 after Minnesota issued a warrant in May, and he has remained in Cameron County jail while the extradition request awaits Abbott's decision.
The shooting was one of three in Minnesota involving federal agents during January immigration enforcement operations under the Trump administration, and Moriarty has separately charged another ICE officer in an unrelated assault case.
