The judge has not yet decided whether Diaz’s claim will even move forward. Michelle Hadley’s new filing is aimed at that stage. She is asking the court to weigh the lasting harm she says Diaz caused and not reduce his sentence. Her letter does not decide the case, but it adds victim-impact evidence to the record as the court reviews his motion. So, at this point, Diaz is attempting to use a narrow post-conviction avenue, but his sentence remains in place unless a judge later finds his lawyer was constitutionally ineffective.
