8th Circuit Affirms 2-Page Kelly v. Bisignano Dismissal Over Exhaustion Failure

The 8th Circuit upheld dismissal of Kelly v. Bisignano, leaving intact the Eastern District of Missouri’s ruling against the plaintiff’s employment claims.
The 2-page per curiam decision said the plaintiff failed to exhaust administrative remedies and failed to state a claim, and found the record supported dismissal.
The panel also found no abuse of discretion in the lower court’s refusal to let the plaintiff supplement the record on appeal-related proceedings.
